By entering our establishment, utilizing our physical services, or accessing our digital ordering platform via Scerv (collectively, the "Services"), you agree to be legally bound by the following Terms of Service. If you do not agree to these terms, please do not use our Services.1. LEGAL AGE REQUIREMENT & VERIFICATIONAge Limit: You must be at least 18 years of age to purchase or consume alcohol (daiquiris, spirits, beer) or use hookah products, in accordance with the laws of the Republic of Panama.Identification: We reserve the right to request valid, government-issued photo identification (Cédula or Passport) from any guest at any time. Service will be refused to any individual unable to provide valid proof of age, without exception or refund.Compliance: By using our Services, you represent and warrant that you are of legal age.2. RESPONSIBLE CONSUMPTION & SAFETYRight of Refusal: We reserve the right to refuse service to any person who appears intoxicated, under the influence of illegal substances, or who poses a safety risk to themselves, our staff, or other guests.Hookah Safety: Hookah use involves high-heat coals. Guests agree to follow all safety instructions provided by staff. Tampering with coals or moving hookah units without staff assistance is strictly prohibited. Any injury resulting from unauthorized handling of equipment is the sole responsibility of the guest.3. DIGITAL ORDERS, PAYMENTS & FEESFinality of Orders: When ordering via the Scerv app, you are responsible for reviewing your basket before submission. Once an item is marked as "Sent to Kitchen" or "Sent to Bar," the order is final and will be added to your bill.Platform Fees: Digital transactions processed through the Scerv platform are subject to a Scerv Platform Fee. This fee is clearly displayed in your Bill Summary before payment.Gratuity: Daiquiri 23 & Hookahs reserves the right to apply an automatic gratuity for parties of six (6) or more, or according to established house policy.Payment Obligations: By placing an order, you authorize the charge for the total amount, including applicable taxes, gratuity, and service fees.4. GUEST CONDUCT & PROPERTYBehavioral Standards: Guests must maintain a respectful demeanor. Harassment of staff, illegal drug use, or violent behavior will result in immediate removal from the premises without refund and potential notification of law enforcement.Damage Liability: Guests are financially responsible for any damage caused to the establishment’s property, including but not limited to furniture, electronics, and hookah units (hoses, bases, or bowls). Breakage fees may be applied directly to your bill.5. HEALTH & RISK ACKNOWLEDGMENTNicotine Warning: Hookah smoke contains nicotine and other chemicals known to cause health risks.Alcohol Warning: Consumption of alcohol impairs your ability to operate machinery or drive a vehicle.Allergies: Please inform staff of any food or drink allergies prior to ordering. We are not liable for allergic reactions resulting from undisclosed sensitivities.Assumption of Risk: By choosing to consume alcohol or use hookah, you voluntarily assume all risks associated with these activities.6. LIMITATION OF LIABILITYDaiquiri 23 & Hookahs and its affiliates (including Scerv Inc.) shall not be liable for any indirect, incidental, or consequential damages arising from your visit. You agree to indemnify and hold Daiquiri 23 & Hookahs harmless from any claims, losses, or expenses resulting from your breach of these terms or your conduct while on the premises.7. PHOTOGRAPHY & PROMOTIONAL MEDIABy entering this establishment, you acknowledge that photography or filming for promotional purposes may take place. You consent to the use of your likeness in our marketing and social media materials unless you explicitly notify management of your objection in writing upon entry.8. MODIFICATIONS TO TERMSWe reserve the right to modify these Terms of Service at any time.
